These conditions govern the sale of all products presented on the JAMINI website.

The parties agree that their relationship will be governed exclusively by this contract.

JAMINI reserves the right to adapt or modify at any time these conditions. In case of modification, the conditions in force on the day of the order will be applied.

If a condition were to fail, it would be considered to be governed by the usages in force for the sector "la vente à distance", in accordance with the French law, which will be the only one applicable.

The Customer must be :

Article 2 : Purpose

The present terms and conditions are intended to define all terms of sale, including ordering, payment and delivery between JAMINI and the Customer.

These conditions express the full obligations of the parties.

Article 3 : Orders

The Customer who wishes to purchase one or more items on the JAMINI website must comply with the following process :

The customer selects the desired product(s) by adding the product to the basket.

After having verified the selection (size, color, price ...), and by applying any possible reduction code in the field provided on the Basket page, the customer validates the choice of the selected product (s) by clicking on Continue.

The Customer must then :

- If an existing Client of JAMINI : fill in the form by indicating only the email address and the password communicated during the first order

- If a new JAMINI Client: fill in the form with the client's surname, first name, contact details, email address, password ... The Customer is free to modify his personal information at any time in "My Account".

The Customer finally chooses the method of payment from the list proposed, accesses a payment page and fills out the secure payment details via Paypal or Visa or Mastercard to finalize the order.

When the order is finalized, JAMINI confirms the order to the Client by sending a summary email to the client.

JAMINI disclaims any liability in the event of a dispute between the Client and the company "PayPal".

JAMINI reserves the right to refuse any order from a Customer with whom a dispute relating to the payment of a previous order has already been established and not resolved.

Any order placed on the site constitutes acceptance of the present conditions, prices and description of products. JAMINI undertakes to honor all orders placed on the online shop. In the case of one or more items not available in the order, JAMINI undertakes to notify the Customer as soon as possible and, if the total amount of the order has been debited, to refund the Customer the amount of the missing items either by crediting The customer's account of a value to be worth on the next order or, else if the Customer requests, by crediting the customer's bank account for this amount.

Article 4 : Price

The price of the products is displayed in euros. VAT is included in the total price invoiced at the rate in force in France for the products concerned.

JAMINI reserves the right to modify its prices at any time without notice. The articles will be invoiced on the basis of the tariffs in force at the time of the confirmation of the order by the Customer.

Article 5 : Product Catalog

JAMINI guarantees the authenticity of the products it offers for sale.

JAMINI undertakes to notify by email or telephone any customer who has placed an order for an unavailable product.

The products offered for sale are presented and detailed with the greatest possible precision. In order to improve the description of the offer, JAMINI may modify or add features to product descriptions.

If the Customer finds any anomaly on the product sheets, he/she is invited by JAMINI to let them know so that it can be corrected as soon as possible.

Article 6 : Payment

Once the basket has been validated and the mode of delivery chosen, JAMINI offers the Customer a 100% secure payment via Paypal or via secure platform provided by HSBC using Visa or Mastercard.

1. Payment via Paypal, the Customer can pay in two different ways:

a. If the customer already has a Paypal account:

The Customer connects to his/her Paypal account and follows the instructions to make the transaction.

b. The customer does not have a Paypal account :

The Customer can pay with his/her credit card. The Paypal service allows the customer to pay via various payment cards :

- Blue card

- Mastercard

- Visa

With Paypal, the Customer's credit card number is not transmitted to JAMINI in any way and each purchase is confirmed by a receipt.

2. Payment via HSBC secure platform :

JAMINI accepts Credit/Debit cards (Mastercard and Visa) to process payments. The client expressly acknowledges that disclosure of their bank card number gives JAMINI the authorization to debit their account to the amount of the order. Once payment is initiated by the customer, the transaction is immediately debited after verification of the information. The customer confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. In case of an unsuccessful transaction, a notice of the order cancellation for error of payment is sent to the client by JAMINI to the email address registered by the client.

The data recorded and kept by JAMINI constitutes proof of the order and all previous transactions. The data recorded by HSBC constitutes proof of the financial transactions.  JAMINI will never keep payment card details of the customer.

The payment system is valid for payment in all countries delivered by JAMINI.

The products remain the property of JAMINI until the complete payment of the order.

Article 7 : Delivery

1. Standard Delivery by Colissimo

Jamini delivers all orders to the address defined by the customer through La Poste (French Post).

The expected delivery time is between 3 to 6 working days from the date of shipping, except in the case of unforeseen events.

Upon dispatch of an order, the tracking number assigned to each package is sent by email, which allows the customer to track the status of the package on the carrier’s website.

2. Delivery by Mondial Relay

- Points Relais : The parcel is delivered by Mondial Relay to the Relay Point chosen by the Customer. This delivery method is valid for France, Belgium, Luxembourg and Spain.

The expected delivery time is between 3 to 6 working days from the date of shipping, except in the case of unforeseen events.

- Home Delivery by Mondial Relay : The parcel is delivered by Mondial Relay to the address defined by the Customer. This delivery method is valid for Belgium, Luxembourg, Spain, Germany, Italy, Austria and Portugal.

The expected delivery time is between 3 to 6 working days from the date of shipping, except in the case of unforeseen events.

3. Express delivery STUART -Paris only-

From Monday to Friday, the package is delivered the same day for orders placed before 4 pm, the next day for others.

4. Click & Collect by Jamini : At 10 rue du Château d'Eau, 75010 Paris

Pick up and return to the store are free. Customers can retrieve their orders from Monday to Saturday from 11:30 am to 7:30 pm with the order number. A confirmation email is sent to the customer as soon as an order is ready for pick up. Please allow 2 working days from the date of order to the date of pick up at store.

Return / Refund

Purchase on our Eshop (except discounted items) : A product may be returned at the client’s own expense by Colissimo with signature, to Jamini, within fourteen days after the receiving date. The products must be returned in their packaging and in their original condition. The client may then be fully reimbursed the amount of the items shipped. In case of receipt of a damaged article, the customer must inform the customer service at +33(0) on the same day the shipment is received.

In-store purchase (except discounted items) : A product may be returned to Jamini, within three months from the date of purchase. The products must be returned in their packaging and in their original condition. The client may then benefit from an exchange or a credit (valid one year) usable on the next order.

Delivery times displayed at checkout are calculated based on shipping destination in order to provide the most reliable information.

For delivery in countries/regions outside of the E.U., we do our best to facilitate customs clearance. However, delivery times may be delayed beyond our will by border control.

JAMINI reserves the right to collect data on the Customer, in particular by the use of cookies in accordance with the legislation in force. The Customer is informed that this computerized processing of data has been declared to the CNIL under the number 1533304.

In accordance with the law n ° 78-17 of January 6, 1978 "Informatique et Libertés", the Customer has a right of access, rectification and deletion of the data concerning him recorded by JAMINI.

The Customer may at any time contact JAMINI and oppose the commercial use of the personal data registered by JAMINI.

Article 10 : Services

Article 11 : Liability / Litigation

The company JAMINI is subject to an obligation of means vis-à-vis the Client. It is expressly agreed that JAMINI can not be held liable for any disruption in the provision of the service for any reason, any external intrusion or infection with computer viruses./p>

JAMINI can not be held responsible for any malfunctioning of the postal services or other delivery services service.

The Client is responsible for the accuracy of the information provided at the time of the order, relating to the address of delivery, billing, email and telephone number. JAMINI cannot be held responsible for the consequences of a possible error in this information. All costs inherent in these consequences shall be borne by the Client.

In case of dissatisfaction of a Customer for any reason, the customer cannot claim any compensation other than the reimbursement of an order.

In the event of a dispute, the French courts shall have exclusive jurisdiction.

Article 12 : Intellectual Property

All elements of the Site (photographs, illustrations, pictograms, and descriptions, logo, trademark) are and remain the exclusive intellectual property of JAMINI.
